Terms of Sale

 

CMS made easy (CMSme) is a service operated by Monkey Island Ltd.  See Terms of Use for general terms of using the CMSme service.  Your trading contract is with Monkey Island Ltd, but this document refers to CMSme throughout.  The term Editor and User both refer to the registered User of the editing software.

 

Backup

Before using CMSme, and as good practice in general, you should always keep a backup of your website(s) in a separate location from your live site(s). Since CMSme remotely accesses files, any changes you publish via CMSme become permanent. Although CMSme keeps track of webpage revisions for a limited period, you should only rely on this as a last-resort recovery method for your webpages.

 

Editors (Users)

One website and up to 5 Editor logins (Users) are allowed per subscription. The User may choose either the standard editing functions or the full editing functions, or upgrade for free at a later stage.  Also included, the User has access to site properties, up to 90 days page change history, and access to a Google Analytics dashboard if desired.

 

The CMSme page editor can be used simply as a “Word-like” text editor, but contains many features pertinent to website content management.  Code inserted is SEO friendly and meets W3C standards.

 

The standard editor allows for editing text and images, with functions for Undo, Redo, Cut, Copy, Paste, Paste Plain Text, Remove Formatting, Search, Find/Replace, Spell Check (User download option), Insert/Edit Hyperlink, Unlink, Insert/Edit Anchor, Insert/Edit Image, Insert Special Character, Toggle Full Screen, File Manager (manage/upload files, such as PDF) and text formatting for Paragraph and Style (usually compatible with the website Style Sheet or “CSS”), Bold, Italic, Bullets, Numbering, Indents and Block Quotation Mark.

 

The full editor allows for all of the standard functions and in addition for Insert/Embed Media (e.g. Video, Sound), Insert Table, Insert Horizontal Ruler, Edit HTML Source and additional text formatting for Editing CSS Style (e.g. colours, font), Insert/Edit Attributes (e.g. mouse rollover), Strikeout,  Sub-Script, Super-Script, Paragraph Alignment (Left, Right, Centre, Block). Page Cloning (used to create new pages from a template designed for your site), Page Delete, Edit Page Properties (e.g. search engine keyword tags).

 

Each Editor may view all pages or be restricted as to which pages they may edit.

 

Additional Users:  Up to four additional Users may be registered.

 

CMSme is not responsible for data loss resulting from use of the service; after initial backup of the existing site by CMSme the User is responsible for maintaining backup copies of their website. For more information, please refer to our Terms of Use.

 

Licence, Charges & Payments

Licence: The User of the CMSme content editor is licensed to use the CMS made easy site and editor only for authorised Editors (Users) within the Terms of Use and only whilst paying the monthly charge.

 

Set-up: After the initial free assessment and in order for CMSme to work it is necessary that CMSme make minor changes to the HTML code of the User’s website. This requires the User to release the FTP (or SFTP) address, username and password (we help get these if necessary). In order for CMSme to work, small technical changes need to be made to each web page;  the complexity of these small changes depends on how the web page was created.  Consequently, CMSme may require a one-off set-up charge for enabling a website to use the CMSme editor; if a charge is necessary, User will be quoted separately. Once the initial set-up has been done, no further technical input from CMSme should be required.  The changes and possible charges apply to each website designated by the customer.  

 

 

User Charge: User is charged at the rate of £10 ($16 US) / month (includes five Editors);

 

 

Subscription payments to Monkey Island Ltd must be automated (e.g. Credit Card, Paypal, Direct Debit).  All payments subject to UK VAT where appropriate and prices quoted here do not include VAT. CMSme reserve the right to alter charges without notice by email to User’s registered email address. The term of the agreement is a rolling one month, thus requiring no notice of termination. Payments must be made by automated credit in favour of Monkey Island Ltd. CMSme reserve the right to terminate the agreement without notice or as stated in the Terms of Use.

 

Set-up fee (if agreed) and the first subscription fee are to be paid prior to commencement of live service.

 

User IPR

Although CMSme needs to make small changes to the User’s web pages, CMSme claim no IPR or other rights in the modified code.  All such rights remain with the registered web site owner. CMSme does not require any external links to or from your site, which therefore remains completely independent of CMSme and the editing service.  

 

Any changes the User makes to their site remain the sole property of the User and CMSme have nor claim any rights whatsoever to content, structure or other properties of the User’s website.  Should the User cancel the CMSme service, their website will remain entirely as it is at the point of cancellation.

 

CMSme normally add a discrete link back to www.cmsmadeeasy.com for SEO purposes; if the User wishes to specifically prohibit the addition of this link, please inform us by email at any time.

 

In addition the User confirms to CMSme that they own or have permission to use all materials on their website including but not limited to the design, all images, all copy, all artwork and other design items.  The User indemnifies CMSme against all claims for misuse of copyright or other rights inherent in the materials on their website.

 

Confidentiality

CMSme will hold all information the User supplies in confidence and will not disclose such information to a third party unless ordered to do so by an appropriate court of law.  In the event that User ceases to pay for the CMSme service, the User website and all Editors will be removed from CMSme records and details of any access codes or passwords given to CMSme will be destroyed.

 

Browser Compatibility

CMSme is compatible with Internet Explorer 7+, Firefox 2+, Safari 3+, Opera 9+, and Google Chrome.  Internet Explorer 6 Users will be instructed to upgrade or download a supported browser before accessing the CMS.

 

Support

CMSme provides customer support via email and/or support forms.  Email support can be obtained from support@cmsmadeeasy.com or via support forms found on the CMSme website Support page or the Help & Support tab on the editor pages.  CMSme endeavour to answer support queries with 8 working hours (Monday to Friday, 9:00 am to 5:00 pm GMT, excluding bank holidays).

 

A Note About Security

CMSme takes every precaution to prevent the unauthorized access of subscriber login information by third-parties. We use 128-bit AES encryption to safeguard your credentials from potential attackers. We also run scheduled penetration testing against our database software to maintain the highest level of security possible.  For more information about the security of your login information, refer to our Terms of Use.

 

Additional Services

The User may wish CMSme to offer help in creating more functionality on a website, with a view to using the CMSme service for self-maintenance.  We offer the following additional services.

 

New Pages: If all you want to do is copy an existing page and edit it - CMSmadeeasy does that as standard; but if you want new pages designed - we can help you do that.

 

New functions: We can help you add any new functions such as Blogs, Site Search, Calendars, Holiday let booking, Forms, Customer registration, Animation, Galleries, Google and Affiliate advertising, and a whole host of widgets.

 

Hosting: There is no need to change hosting in order to use CMSme. If you want to transfer the hosting, we will place the hosting with a major hosting company for £75 per annum.

 

Website Creation: CMSme also create new, professionally designed websites which can be self-maintained using CMSme.  Ask us for a quotation on an individual basis - our prices are generally well below design agency charges.
